Judge Lays to Rest Janet Jackson Wardrobe Malfunction

Janet Jackson is in the news again for exposing her nipple during a Super Bowl half time show in 2004. A panel in the 3rd U.S. Circuit Court has tossed out the Federal Communications Commission fine for the incident, valued at $550,000, levied against CBS Corp. for airing the so-called wardrobe malfunction.

Jackson, performing at the show with Justin Timberlake, was exposed when Timberlake ripped back a piece of her suit around her breast. Supposedly, there was additional cloth material underneath but anyone who actually saw the performance could believe it went off exactly as intended.

That aside, Jackson took an amazing amount of flack for something that was both supremely hot and well-choreographed. It’s one of the best half time shows the Super Bowl has managed to put on in a years and the fallout was beyond ridiculous. (Plus, Jackson’s breast was covered in…what would you call it? A nipple plate?)

The Circuit judges dismissed the indecency fine on the grounds that the FCC departed from a “well-established course of action” in levying the fine against CBS. The judges found the incident was “unintended” despite the FCC’s contention at the incident was “willful.”
